Panama trademark registration Requirements

  • Sworn affidavit about trademark use.

  • If the mark has a special design, is an image, logo or 3D, two copies of it must be attached to the application (in physical or digital format, depending on the channel).
  • If the trademark is in the process of registration in another country and has priority, the priority document of the country where the trademark application is filed, authenticated by a notary public, and legalized by the Panamanian Consulate of said country or by means of the Apostille, will be required.

F.A.Q. about Panama trademark

A: Trademark registration in Panama is not mandatory to use it. However, the registry grants exclusive rights of commercial use, protecting it legally from unauthorized uses or conflicts. Without formal registration, defending your intellectual property before DIGERPI or other legal instances will be more difficult.

A: Even if a trademark is registered in another country, it does not mean that it is automatically valid in Panama. To protect it legally here, it is advisable to verify its local availability and, if possible, to register it. Using a trademark registered abroad could generate legal conflicts when taking your business overseas or if a Panamanian registration already exists.

A: In Panama you can register invention patents (new products or processes with industrial application), utility models (functional improvements of existing objects) and industrial designs (visual appearance of a product), protecting different aspects of technical or aesthetic creativity.
